INFORMATION ON THE PROCESSING OF PERSONAL DATA

(art. 13 of EU Regulation 679/2016 – General Data Protection Regulation – GDPR)

DATA CONTROLLER

1 - PURPOSE OF THE PROCESSING

1.1 – Contractual purpose: the personal data (“Data”) you provide will be processed in order to use the services offered by the Company, including through the website www.oliosortino.it (“Site”), for contractual, management, accounting, and tax purposes.

1.2 – Legal obligations: the Data will be processed to comply with obligations provided for by regulations and applicable national and supranational legislation, including accounting and tax matters.

1.3 – Rights of the data controller: the Data will be processed, if necessary, to ascertain, exercise or defend the rights of the Company in court.

1.4 – Out-of-court debt collection: the Data will be processed, if necessary, in order to allow the Company to recover its credits without resorting to a judicial authority.

1.5 – Operation of the Website: the Data will be processed by the computer systems and software procedures used for the operation of the Website, which acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. These are pieces of information that are not collected to be associated with identified data subjects, but which, by their very nature, could, through processing and association with data held by the Company or by third parties, allow users of the Website to be identified.

2 - LEGAL BASES OF PROCESSING

2.1 - Contractual purpose: execution of a contract to which you are a party, or to use the Site and take advantage of the services offered by the Company, also through the Site.

2.2 – Legal obligations: necessity to fulfill legal obligations.

2.3 - Rights of the data controller and out-of-court debt collection: legitimate interest.

3 - PERIOD OF RETENTION OF PERSONAL DATA

3.1 - Contractual purpose, Legal obligations: for the entire duration of the contract and, after termination, for 10 years.

3.2 - Rights of the holder and out-of-court debt collection: in the case of out-of-court disputes, for the entire duration thereof, until the expiry of the time limits for lodging appeals.

3.3 – Operation: After the above-mentioned retention periods have elapsed, the Data will be destroyed, deleted, or anonymized, in accordance with the technical procedures for deletion and backup.

5 - MANDATORY NATURE OF DATA PROVISION

The provision of the Data referred to in point 4.1 for the purposes indicated in point 1.1 is mandatory. Refusal to provide the aforementioned personal data therefore makes it impossible to use the Company's services, including through the Website.

In the processing of personal data that may, directly or indirectly, identify you, we adhere to a principle of strict necessity. For this reason, we have configured the Site so that the use of personal data is kept to a minimum and so as to limit the processing of personal data that allows you to be identified only when necessary or at the request of authorities and law enforcement agencies.

6 - DATA RECIPIENTS

The data may be processed by external parties acting as independent controllers such as, by way of example, authorities and supervisory bodies and

control and, in general, entities, public or private, authorized to request the data.

The data may also be processed, on behalf of the Company, by external parties appointed as data processors, to whom appropriate instructions are given

operative. These subjects are essentially included in the following categories:

a. companies offering transport services;

b. companies and professionals who offer banking, administrative, accounting, credit protection and Company rights services;

c. companies and professionals offering insurance services;

d. companies that offer management, maintenance, and development services for the Company's and the Site's information systems;

e. companies that offer support in conducting market research.

7 - SUBJECTS AUTHORIZED TO PROCESS DATA

The Data may be processed by employees of the Company's business functions and by appointed managers, responsible for pursuing the purposes

above indicated, who have been expressly authorized to process and who have received adequate operational instructions.

The Data referred to in point 4.2 collected during navigation of the Site will be processed exclusively by the Data Controller.

8 – YOUR RIGHTS AS A DATA SUBJECT - COMPLAINT TO THE SUPERVISORY AUTHORITY

By contacting the Company you can request:

1) access to the Data concerning you,

2) their deletion,

3) the rectification and integration of inaccurate or incomplete Data,

4) the restriction of processing in the cases provided for by Art. 18 of the GDPR,

5) opposition to processing in cases of legitimate interest of the Company,

6) in the event that the processing is based on consent or contract and is carried out by automated means, you have the right to receive

in a structured, commonly used and machine-readable format your personal data, as well as, if technically feasible, to transmit them to another controller without hindrance.

7) in the cases provided for by Art. 22 of the GDPR, the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

9 – DATA SECURITY

Your personal data will be processed with automated tools for the time strictly necessary to achieve the purposes for which they were collected and in compliance with the principle of necessity and proportionality, avoiding the processing of personal data when operations can be carried out using anonymous data or by other means. Our computer workstation, located at the residence of the data controller in via Castellammare 276, Crocevie Valderice, is equipped with Windows 10 or higher software, serial code 00330-71304-41461-AAOEM, always updated to the latest release, and antivirus with a licensed version of McAfee Total Protection version 16 and later, updated with a valid license.

We have adopted specific security measures to prevent the loss of personal data, unlawful or improper use, and unauthorized access, but please remember that it is essential for the security of your data that your device is equipped with tools such as constantly updated antivirus software and that the provider supplying your Internet connection ensures the secure transmission of data through firewalls, anti-spam filters, and similar safeguards.
